New Albany maintains specific fence regulations that reflect its carefully planned development:
Permit Process:
- Submit applications to the Community Development Department
- Required documentation: Scale drawing of the lot showing actual location of proposed fence
- Property owner must certify the fence doesn't encroach on another lot
Height Restrictions:
- Between building setback line and street (3 feet from right-of-way): Maximum 54 inches (4.5 feet)
- Behind building setback line: Maximum 72 inches (6 feet)
- No fence permitted within 3 feet of street right-of-way line
Material Restrictions:
- Prohibited types: No electrically charged fences
- Safety requirements: No fences with wire/metal prongs, spikes, or other cutting points/edges
Special Considerations:
- Minimum 3-foot setback from street right-of-way required
- No fence, hedge, or wall shall obscure motorist vision within 25-foot clear sight distance along streets approaching an intersection
- Fence definition includes hedges or other plants that enclose, partially enclose, or divide premises
- Trellises for supporting vines/flowers may be considered fences if they enclose or divide premises
